(1)  The data processing practices carried out by Hotel Express International, its agents and suppliers through the use of the features and services of this web site (individually and collectively, the "Site”)

(2)  The legal terms of use of the Site.

(1)   How information submitted via the Site is gathered, why it is collected, and what it is used for; 

(2)  The requirements that you must agree to follow if you use this Site.

A.     FORMS AND GATHERING OF DATA

All data supplied by you falls into one of two categories:

By completing and submitting your Personal Data into the features of this Site, you automatically consent to Hotel Express International’s rights to the following:

(b)   Permission to contact you with relevant material, for example, about your use or potential use of this Site and other relevant sites, or other material about hot-ex.com or Hotel Express International.

Unless otherwise stated, all material on the Hot-ex.com site is either owned by Hotel Express International, and/or its respective agents, suppliers or licensors, and is protected by copyright and trademark laws. You may not copy, modify, reproduce, republish, post, transmit or distribute in any way any material from this Site, save as authorised by these Terms and Conditions.

You are only authorised to use the Site and its contents for your personal, non-commercial use. This amounts to viewing the Site and printing off individual pages or sections for personal use.

Any content provided by you as a result of you engaging in any other form of communication through this service, although owned by you, is subject to a royalty-free, perpetual, non-exclusive, unrestricted, world-wide licence allowing Hotel Express International to use, copy, sublicense, adapt, transmit, publicly perform and display any such content.

B.     OBLIGATIONS

Hotel Express International will endeavour to ensure that the Site feature(s) controlled by it (as specified below) will be available at all times and that the content on the Site controlled by it is true, accurate and error free. However, we cannot guarantee this or provide warranties other than as specifically stated herein. Every Site user must agree to look solely to the assets of the party responsible for administering the particular Site feature(s) in question for any recourse relating to that Site feature, and not to the other entities listed in these Terms and Conditions or any of their officers, directors, shareholders, agents, representatives or employees. 

C.     USER’S OBLIGATIONS

You warrant that all content submitted or posted by you to the Site does not violate the rights of any third party. You will ensure that all information provided by you is accurate and true. D.     HOTEL EXPRESS INTERNATIONAL’S RIGHTS

Hotel Express shall have the right, and not the obligation, to monitor any publicly posted material and to, without notice, edit, delete or remove any material postings or comments on the Site that it deems inappropriate or otherwise in violation of these Terms and Conditions.

E.     DISCLAIMER / LIABILITY

Use of the Site and information gathered through the use of any features of the Site is entirely at your own risk.  Hotel Express International hereby expressly disclaim, to the fullest extent allowed by law applicable, all warranties, express or implied, of any kind whatsoever including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and infringement.

In respect of Hotel Express International and/or their respective agents, suppliers and/or licensors shall not be held responsible for the failure of performance of the Site or Site features or the software used therein or obtained therefrom; the loss of data or services resulting from delays, non-deliveries, mis-deliveries, or service interruption; the accuracy, quality or nature of information obtained through Site services; nor the consequences arising from or related to any viruses transmitted through Site servers.  Additionally, none of them shall be responsible for any liability, whether direct or indirect, foreseeable or otherwise, and even if advised of the possibility of such liability, costs, loss of profits, or consequential losses arising from your use of, or inability to access this Site, to the fullest extent such limitation of liability is allowed by law. The information and services included on Hot-ex.com may include inaccuracies or typographical errors. Changes are periodically added to the information herein. Hotel Express International may make improvements and/or changes in the Site at any time.

This Site may be linked to or from other sites that are not maintained by Hotel Express International.

(1)      Control in any respect any information, products or services offered by such other linked sites and shall NOT be responsible for the content of such other sites. For example, users may be able to buy goods and services via the Site, some of which may be through third party retailers who are linked to the Site. Users may also enter into correspondence with or participate in promotions of advertisers on the Site;

(2)      In no way endorse these third parties and any such transactions, dealings, correspondence with or participation in promotions of, third parties, including the delivery of and the payment for goods and services and any other terms, conditions, warranties or representations associated with such matters are solely between the corresponding user and the third party; and/or

(3)      Assume any liability, obligation or responsibility for any part of any such transaction, dealing, correspondence or participation.

III.  JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with the laws of Norway and the parties submit that all disputes (unless otherwise determined by a countries’ national laws)

If any provision(s) of the Terms and Conditions is held to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.

Nothing set forth herein is intended to conflict with any of the other terms and conditions relating to specific products or services offered or sold through the Site.  [This is not what is meant.  Fax, e-mail and post are all media that currently exist.  We do not plan to do sales through any form of media that doesn’t currently exist, so the addition makes no sense.
